These Terms and Conditions ("Terms") govern your access to and use of BabelStreamer, including our website, browser extension, OBS plugin, dashboard, and related services (together, the "Service"). The Service is operated by Kamayu B.V., a company incorporated in the Netherlands ("BabelStreamer", "we", "us"). By creating an account, installing the extension or plugin, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

BabelStreamer provides real-time, machine-generated speech translation and captioning for live streams, delivered via a browser extension, an OBS plugin, and a companion dashboard. The Service relies on automated speech recognition and machine translation, including third-party and self-hosted AI models, to produce captions and translations with as little delay as we can manage.

Machine translation is not perfect. Output may be delayed, incomplete, mistranslated, or otherwise inaccurate, particularly for fast speech, background noise, slang, or less common languages. You should not rely on the Service for translations where accuracy is safety-critical, medical, legal, or otherwise carries serious consequences if wrong.

We don't moderate, review, or edit what a Streamer says. The Service translates speech faithfully, whatever that speech is — we take no editorial role in it and don't screen it before, during, or after translation. A Streamer is solely responsible for their own content, including anything captioned or translated from it; we're not responsible for it and don't endorse it. This doesn't excuse a Streamer from Section 6 (Acceptable Use) — it just means the Service itself won't be the thing deciding what does or doesn't get translated.

2. Viewers

Not everyone who uses the Service is a Streamer. If you watch a stream through the browser extension or a shared viewing link without ever creating a BabelStreamer account, you're a Viewer — and using the Service that way still means you accept these Terms. The parts written for you are the ones about using the Service responsibly and about our own liability: Sections 6 (Acceptable Use), 7 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), and 13 (Governing Law and Disputes). The sections about accounts, subscriptions, billing, and refunds are written for Streamers and don't apply to you, since you're not creating an account or paying us anything.

The Streamer whose captions you're watching is responsible for the content of their own stream — we're not a party to whatever happens between you and them.

3. Accounts

Some features require an account. We use passwordless (magic-link) sign-in — you are responsible for keeping access to the email address on your account secure, and for all activity that occurs under it. Tell us immediately if you believe your account has been compromised.

You must be at least 16 years old to create an account. If you are under the age of majority in your jurisdiction, you may only purchase a paid Subscription with the involvement and agreement of a parent or legal guardian, who accepts these Terms on your behalf for that purpose.

4. Subscriptions and Billing

Paid plans are billed on a recurring basis (monthly or annually, as selected at signup) through our payment processor, Stripe. By subscribing, you authorize us to charge your chosen payment method for the recurring fee until you cancel.

Right of withdrawal (EU consumers)

If you are a consumer in the EU, you normally have a 14-day right to withdraw from a distance contract without giving a reason. Because the Service is a digital service that we make available to you immediately upon payment, by subscribing you expressly request that we begin performance right away, and you acknowledge that you lose your right of withdrawal once we have started providing the Service to you. If you'd prefer to keep the withdrawal right, contact us before use begins and we'll hold off.

5. Refunds and Service Failures

We want the Service to work. If it doesn't — a bug, an outage, or another failure on our part that materially prevents you from using a paid feature you're subscribed to — tell us at info@babelstreamer.com and we will first try to fix the problem. If we can't fix it within a reasonable time, your remedy is a pro-rated refund of the Subscription fees you paid for the affected period. That is your sole and exclusive remedy for a Service failure, to the extent permitted by law — see the liability cap in Section 11.

This section doesn't override any statutory right you have as a consumer that can't be excluded by contract (Section 11 lists those carve-outs).

7. Intellectual Property

We own the Service, including the software, models, trademarks, and branding used to provide it. Nothing in these Terms transfers that ownership to you; we grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain all rights to your own stream audio and content. By using the Service, you grant us a limited license to process that audio (including transmitting it to translation models) solely to generate and deliver captions and translations to you and your viewers in real time. See our Privacy Policy for what we do and don't retain.

8. Availability and Changes to the Service

We may modify, suspend, or discontinue any part of the Service, including individual languages, features, or plans, at any time. Where a change materially reduces what a paid plan offers, we'll give reasonable notice where practical. We don't guarantee the Service will be available uninterrupted or error-free — it depends on third-party infrastructure, network conditions, and streaming platforms outside our control.

Features may be labelled as beta, early access, or experimental. These are provided as-is, may change or be removed without notice, and may carry a higher risk of bugs or downtime than the rest of the Service.

9. Termination

You may stop using the Service and cancel your Subscription at any time from your account settings. We may suspend or terminate your access if you breach these Terms, including the Acceptable Use section, or if we reasonably believe your use poses a risk to the Service or other users. Where practical, we'll give notice and a chance to fix the issue before termination for anything short of serious or repeated breaches.

Sections that by their nature should survive termination — including Sections 7, 10, 11, and 13 — continue to apply after your account is closed.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that captions or translations will be accurate, complete, or delivered without delay.

This section does not affect any statutory warranty or conformity right you have as a consumer that cannot lawfully be excluded.

11. Limitation of Liability

In plain terms: if something we're responsible for goes wrong, the most you can recover from us is a refund of what you paid for the affected Subscription period. We don't cover indirect losses like lost revenue, lost sponsorships, or lost viewers.

To the maximum extent permitted by applicable law, our total aggregate liability to you arising out of or relating to these Terms or the Service — whether based in contract, tort (including negligence), or any other legal theory — will not exceed the greater of (a) the amount of Subscription fees you paid us in the three (3) months immediately before the event giving rise to the claim, or (b) a full refund of the Subscription fees for the billing period during which the failure occurred, at our choice.

In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, sponsorships, viewers, or data, even if we were advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) intent or wilful misconduct, or gross negligence, on our part; or (d) any other liability that cannot be limited or excluded under the laws of the Netherlands or another jurisdiction whose mandatory consumer-protection rules apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the Service, or content you stream through it, except to the extent caused by our own breach or negligence.

13. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Disputes will be submitted to the competent court in the Netherlands, without prejudice to any mandatory right you have as a consumer to bring proceedings in the courts of your own country of residence, or to any other statutory consumer right you cannot contractually waive.

If you're an EU consumer, you can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. If a change is material, we'll notify you (for example, by email or an in-app notice) before it takes effect. Continuing to use the Service after a change becomes effective means you accept the updated Terms.
